Terms of service

Customer Cancellations:

  • Once an employee is scheduled (customer), the customer must give a 48-hour cancelation notice if the employee is not needed for the scheduled day(s).  If (customer) does not communicate with the (independent contractor) before 12 hours, the employee will be paid a two-hour show-up fee and be paid the negotiated hourly pay rate.
  • No cancellation fee if notified in > 48 hours
  • 50% of hourly pay for the remainder of the *scheduled* week if the employee is not notified within 24 hours of the shift.
  • 100% of hourly pay for the remainder of the *scheduled* week if the employee is not notified at least 24 hours in advance.
  • There will be no fee applied if the customer moves an employee to a new job site that is within 20-miles from the originally scheduled job site.
  • The job posting will be removed, and the assigned (independent contractor) will be available to work, and a FlexCrew staff member will assist in quickly re-assigning the (independent contractor). 

Independent Contractor Cancellations:

  • Failure to show once scheduled is an automatic deduction of a one-star rating.  If the employee fails to show up for a scheduled shift 3 times, the employee will not be eligible to apply for jobs for three months and will automatically have a max rating of two stars. 
  • If employees do not submit their hours within 1-hour of completing a shift, they are not eligible for same-day-pay.
  • If the employee does not exemplify the experience listed during verification, they will be demoted at least one tier.
  • If an employee fails a required pre-employment drug test, the employee will not be able to apply for jobs for 6 months from the day of a failed drug test.

Employee Payments:

  • After each shift, the (independent contractor) has one hour to submit their time for that day.  The (customer) has two hours to approve this time.  If the customer does not approve the submitted time in two hours or less, they will be automatically billed for the hours worked.
  • If (independent contractor) does not submit their hours within 1-hour of completing a shift, they are not eligible for same-day-pay.
  • (Independent contractors) will be charged a 1.5% fee for instant transfers from their Crunch wallet.
  • (Independent contractors) are responsible for coming prepared on day 1 with the proper tools and PPE as represented in the job description.

Independent Contractor Review Terms:

  • Employees must submit a formal dispute on a customer rating within 24 hours of receiving the poor review, which will be reviewed by the FlexCrew team. 
  • If (independent contractor) does not submit their hours within 1-hour of completing a shift, they are not eligible for same-day-pay.
  • If the employee does not exemplify the experience listed during verification, they will be demoted at least one tier.
  • If an employee fails a required pre-employment drug test, the employee will not be able to apply for jobs for 6 months from the day of a failed drug test.
  • Employee moves
    • Once an employee is assigned to a specific customer, the customer is authorized to transfer employee to another job site during the negotiated duration of work. 
      • Customer must notify the employee and create a new job on FlexCrew to schedule the employee to. 
      • Customer will be charged the IRS mileage rate to the employee for all miles over 20 miles from the original job site.

Independent Contractor 1099 Expectations:

  • All employees working on the app are responsible for upholding the annual tax payment requirements outlined on the 1099 form.

Customer Billings:

  • Customers paying via ACH will receive a 2% (up for change) discount off the standard 35% markup.

Customer Job Posting Requirements:

  • Customers are required to list all pre-employment documents/drug testing/etc. Prior to the employee showing up on-site.

    • For a subscription fee, the customer can have FlexCrew handle all pre-employment paperwork on behalf of the employee and customer. 
    • The customer must also list all PPE and safety requirements on the job posting. 
  • Worker moves
    • Once an employee is assigned to a specific customer, the customer is authorized to transfer employee to another job site during the negotiated duration of work.
